At least 75% of the oil reform debate and legislation of 2008 was concerned, directly or indirectly, with procurement in Pemex. In April the government proposed a mixed, triadic system in which investor-contractors had an important role. The specification of those activities deemed to be mission-critical, however, is left open to the discretion of the Pemex corporate board and its technical committee on procurement (Art. 26).
Expectations of new business opportunities, both by service providers as well as by IOCs, ride on the validity and application of this distinction. In this report we identify the obstacles, political, legal and institutional, that stand in the way of a full implementation of this dual procurement system; and we worry that the default situation is business-as-usual.
By way of introduction, we review a half-dozen selected cases of problematic procurement, including the one that led to the death of Interior Minister Juan Camilo Mouriño in 2008. The 13-page management report includes 8 figures, 4 tables and 40 technical, bibliographical and anecdotal notes.
